US EB5 – PROGRAM

The EB-5 Program, overseen by the United States Citizenship and Immigration Service, offers entrepreneurs the opportunity to obtain a green card and permanent residency in the United States for themselves, their spouses, and unmarried children under 21 years old.
This program serves a dual purpose: (1) stimulating capital investment by foreign entrepreneurs in the US economy, leading to job creation; (2) attracting qualified investors to contribute to economic growth.
To be eligible, investors must invest in a new commercial enterprise established after November 29, 1990, or restructured/reorganized with a 40% increase in net worth or employee count, resulting in a new commercial entity.
Additionally, investors must be at least 21 years old and provide documentation proving that their assets and funds are obtained through legal means.

There are two investment options available to applicants:

Commercial Enterprise 1. An investment of US$1,000,000 in a new enterprise or,
2. An investment of US$500,000 in a new enterprise in a specific commercial area
3. Active management of daily operations and/or regulation development of the business Regional Center • An investment of US$500,000 Programme specifics: 1. No minimum educational attainment needed
2. No language testing
3. No experience in business or management required
4. No requirement to reside in investment area
5. Funding may come in the form of a gift, inheritance, business ownerships, or other legal enterprise
6. Coverage includes dependent children under 21 years of age

E1 / E2 Visa Program

E1 Treaty Trader

For businesses and individuals involved in significant international trade between the US and the treaty trader country, the level of trade must be substantial enough to generate employment for a considerable number of individuals in the United States. Additionally, it should represent the primary portion of the trader’s international trade activities.

E2 Treaty Investor

For those who have made a significant investment in a US business in which the investor has at least a 50% ownership. The investment must be sufficient to provide employment for a number of people in the United States and must be in an active US business.

Process:

1. Sign Up
2. Receive Docs checklist
3. Attorney provides detailed business plan idea
4. Open Escrow account in USA for funds transfer
5. Deal between Joint venture company/take over or own business
6. File to USCIS (1 month approval)
7. Visa Interview in India
8. Obtain E1/E2 visa for 2 years renewable
